8. Shipping and delivery of Products

 
 
8.1 Whereas "shipment" of the Products by Prensil Sas means the delivery of the same to the couriers selected from time to time pursuant to art. 8.2, it is not obliged to ship the Products until it has received payment of the Price (except for cash on delivery); once it has received payment of the Price, it undertakes to ship the Products:
 
(i) in the case of available Products (as defined in Article 4 of the Terms of Sale):
 
- within 5 business days of receipt of the debit authorization notice, as defined in Article 7.2 of the Terms of Sale, in case of payment through PayPal;
 
(ii) in the case of available Products that have become unavailable (as defined in art. 4.3 of the conditions of sale), within 3 working days from the moment that such Product or Products are again available at the warehouses of Prensil Sas, without prejudice to the Customer's right to withdraw the Order pursuant to the same art. 4.3;
 
(iii) in the case of Products "on demand" (as defined in art. 4.4 of the conditions of sale), within 3 working days from the moment in which the same are available at the warehouses of Prensil Sas;
 
(iv) in the case of "customized" Products, (as defined in art. 4.5 of the conditions of sale), within 3 working days from the moment the same are available at the warehouses of Prensil Sas;
 
(v) in the event that the availability of one or more Products is not indicated (as per the option set forth in art. 4.6 of the conditions of sale) and the Products are available at the Prensil Sas warehouses at the time the Customers send the Order:
 
- within 3 working days of receipt of the debit authorization notice referred to in art. 7.2 of the conditions of sale in case of payment by credit card;
 
(vi) in the event that the availability of one or more Products is not indicated (as per the option referred to in art. 4.6 of the conditions of sale) and the Products are not available at the Prensil Sas warehouses at the time the Order is sent by the Clients, within 3 working days from the time the Products are available at the Prensil Sas warehouses.
 
 

8.2 The Products are guaranteed to be shipped, in the states indicated in the On-Line Shop, by means of express couriers selected from time to time depending on the Product object of the Order and the place of destination. The Products are shipped by Prensil Sas, and delivered by the courier selected by Prensil Sas, to the address indicated by the Customers at the time of registration under clause 6.1 of the Terms and Conditions of Sale or to a different address indicated at the time the Order is placed.
 
 

8.3 It undertakes to use its best efforts to ensure that the Products shipped pursuant to Articles 8.1 and 8.2 are delivered by the selected couriers:
 
- in Italy within 48 hours from the date of shipment;
 
- outside Italy within 15 days from the date of shipment.
 
 

8.4 The Delivery Terms referred to in art. 8.3, cannot, in any case, be considered binding and Prensil Sas, not being able to directly control the deliveries of the Products after their shipment, cannot be held responsible in any way for their non-compliance.
 
 

8.5 In order to allow Customers to track the status of the Orders, an Order number is generated which, inserted in the "My Orders" section - accessible from all the pages of the On-Line Shop - allows to check all the information related to the Orders.
 
 

8.6 The Customers may also verify the status of the Orders thanks to the online "Order Tracking" function provided by the courier chosen for the delivery. Such verification can be carried out by the Customers only after the shipment of the Products and using the tracking data communicated by e-mail or by accessing the Profile.
 
 

8.7 The Customers, or other persons appointed by the Customers who are at the address indicated for the delivery of the Products in the Order Confirmation, shall verify, upon delivery, that:
 
(i) the Products correspond to what is indicated in the courier's transport document (DDT) both in number and type;
 
(ii) the packaging/packaging of the Products is intact, not damaged, nor wet or otherwise altered, including in the sealing materials.
 
 

8.8 Any damage to the packaging/packaging of the Products must be immediately challenged by the Customers by placing a written control reservation on the courier's proof of delivery. It is understood that once the courier's document has been signed without any objection, the Customers may no longer raise any objection with reference to the external characteristics of what has been delivered.
 
 

8.9 Products may be delivered by couriers only to Customers or persons authorized by them; the person to whom the Products are delivered must affix a signature to certify delivery. Couriers shall not make deliveries at post office boxes or by placing the Products in letterboxes or other similar places.
